This agreement contains the complete terms and conditions that apply to the purchase of the products described on this site. As used in this Agreement “Merganzer Health” means Merganzer Health Ltd., “PRODUCTS(S)” means the product(s) described on this site under products, and the “BUYER” means the person ordering the “PRODUCT(S)”.

These terms and conditions are applicable for PRODUCTS(S) you purchase today through this site (on-line shopping electronic store), and may be different from the terms and conditions of purchase for other product(s) you purchase from Merganzer Health – therefore, please carefully review these terms and conditions before purchase.

Superseding effect

These terms and conditions apply to all Merganzer Health business transactions conducted via this on-line shopping electronic store. To the extent these terms and conditions of sale differ from those outlined in other agreements with Merganzer Health these terms and conditions shall control.

Purchases on the electronic store

All orders and purchases made through this website are subject to the following;
You agree to pay – you agree to pay for all charges noted herein as payable by you.
All prices listed on this website are in Canadian dollars CDN$ and all charges will be processed in Canadian dollars CDN$.

Purchases may be made by credit card (Visa or Mastercard) and via online entry.

You must be 18 years of age or older to purchase from the website.

You may only purchase or order items for professional dental or medical purposes.

Prices and promotional discounts are subject to change without notice.

All prices listed on this website are subject to confirmation. Merganzer Health will notify you by email within 2 business days of making a purchase if the confirmed price of an item you have selected differs from the price listed on the website or on your purchase order. If you do not receive an email within 2 business days of completing a purchase order, Merganzer Health is deemed to have confirmed the purchase at the price listed. If you receive such notification, the sales will be automatically terminated unless you reply by email with confirmation of your intention to purchase the item at the confirmed price.

In order to protect you and Merganzer Health from fraudulent transactions, Merganzer Health may provide your transaction-related information to a reputable third party organization to perform an address verification. This address verification is intended to ensure the “bill” to address that you provide matches your credit card address. Merganzer Health also reserves the right, at its discretion not to ship items ordered or purchased on this website to certain addresses. In the event that Merganzer Health chooses not to ship an item, you will be notified by email and any amount charged to your credit card will be refunded.

Merganzer Health is required to collect sales tax based on the purchase/ship to address.

PRODUCT(S) may be added or removed from electronic store at any time without advance notice. The offer of PRODUCT(S) for online sale in no way commits Merganzer Health to continue to offer the same items(s) or format for sale in the future.

Merganzer Health reserves the right to limit sale or quantities of PRODUCT(S) available through the electronic store. Merganzer Health reserves the right to exercise its discretion to decline sale of any PRODUCT(S), to a prospective purchaser. If Merganzer Health rejects the order, then Merganzer Health will notify the BUYER the order has been rejected.

Transportation Policy

Merganzer Health will use commercially reasonable efforts to deliver items as quickly as possible and within any time periods indicated; however, Merganzer Health will not be responsible for any delays in delivery which are beyond its control. Where delivery is delayed, Merganzer Health will notify you as soon as possible.

PRODUCT(S) purchased on the electronic store will be delivered as chosen by the BUYER according to their selection. Shipping charges are based on geographic location and method of delivery.

A shipping and handling fee of $5.00 for general mail delivery. General mail delivery option is limited to purchases under $125.00. Merganzer Health is not responsible for general mail delivery and the BUYER assumes the risk of shipping without tracking ability.

Return of Merchandise

Merganzer Health will accept returns within 60 days of purchase date upon approval of a return authorized number.

All returns must be pre-authorized by Merganzer Health. To obtain a return authorization number call Meganzer Health at 289-837-4113 or email info@meganzerhealth.com

Postage paid labels will be supplied by Merganzer Health for Authorized returns where Merganzer Health is responsible for paying freight costs.

Credit will be issued by Merganzer Health upon Merganzer Health receipt of the authorized goods being returned in reasonable condition. A credit will be issued based on invoice value at the time of purchase.

Reason for Return

Merganzer Health Error 100% Credit. Freight paid by Merganzer Health.

Product Quality Failure 100% Credit through complaint handling system, will be issued upon receipt of PRODUCT(S) if Merganzer Health is notified within 14 business days of Merganzer Health ship date. Freight paid by Merganzer Health.

Damaged Material 100% Credit through complaint handling system, will be issued upon receipt of PRODUCT(S) if Merganzer Health is notified within 14 business days of Merganzer Health ship date. Freight paid by Merganzer Health.

Shipping Shortages 100% Credit or replacement of missing PRODUCTS(S), with proof of delivery to Merganzer Health within 14 days of Merganzer Health ship date. Freight paid by Merganzer Health.

Shipping Overages 100 Credit of returned PRODUCT(S), will be issued upon notification within 14 days of Merganzer Health ship date. Freight paid by Merganzer Health.

Standard Stock Return – Inventory returned to Merganzer Health along with a copy of the packing slip within 14 days of shipment date 100% Credit provided. Freight paid by customer.

Warranty and Limited Remedy

The PRODUCT(S) will meet Merganzer Health or the manufacturer’s specifications for PRODUCT(S) at the time of shipment. Merganzer Health MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. If a PRODUCT(S) is defective, BUYERS exclusive remedy and Merganzer Health sole obligation shall be, at Merganzer Health option, to replace the PRODUCT(S) or refund the purchase price.

Limitation of Liability

Merganzer Health will not be liable for any loss or damage arising from the PRODUCTS(S), whether direct, indirect, special, incidental or consequential, regardless of the legal theory asserted, including warranty, contract, negligence or strict liability.

Export Terms and Conditions of Sale

All international sales are final and goods sold are non-returnable.

Export freight is charged per FEDEX International.

All freight charges will be added to the total of the shopping cart.

An email will be sent with freight charges to be approved.

Acceptable terms of payment are Visa and Mastercard.

Export deliveries require additional processing time.

If BUYER refuses or fails to take delivery of goods tendered in accordance with this agreement, Meganzer Health shall be entitled to terminate the agreement with immediate effect. Merganzer Health may recover from the BUYER any loss and additional costs incurred as a result of such refusal or failure.

Security

You are prohibited from violating or attempting to violate the security of the Merganzer Health website, including, without limitation: (a) accessing data not intended for you, including logging into a server or account which you are not authorized to access, (b) attempting to probe, scan or test the vulnerability of a system or network to breach security or authentication measures without proper authorization, (c) attempting to interfere with, disrupt or disable service to any user, host or network, including without limitation, via means of “denial of service” attacks, overloading, “flooding”, “mailbombing” or “crashing”, (d) forging any TCP/IP packet header or any part of the header information in any posting, (e) disrupting network nodes or network services or otherwise restricting, inhibiting, disrupting, or impeding the ability of Merganzer Health to monitor or make the website available, or (f) taking any action in order to obtain services to which that you are not entitled. Violations of system or network security may result in civil or criminal liability. Merganzer Health will investigate occurences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting you if you are involved in such violations.

Controlling Laws

This agreement will be construed and interpreted in accordance with the laws of the Province of Ontario.
